These Terms govern access to the MLOONG BLD website and purchases from the online store operated by MLOONG DIGITAL LIMITED. By accessing the site or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Services or place an order.
Eligibility and Consumer Use
You must be at least the age of majority in your state of residence and legally capable of entering a contract. Products are offered for lawful end use. You may not use the Services for fraud, unlawful resale, sanctions evasion, export-control violations, abuse, or interference with the site or other customers.
Accounts and Information
You are responsible for accurate account, billing, shipping, and contact information and for safeguarding account credentials. Notify us promptly of unauthorized access. We may suspend an account or order when reasonably necessary to investigate suspected fraud, security risk, abuse, or violation of these Terms.
Products and Specifications
We try to describe products accurately, but colors, packaging, minor cosmetic details, and on-screen images may vary. Product-page specifications and the order confirmation control over general marketing statements.
Where a listing expressly states that a component brand or model may vary, we may use a compatible component with reasonably equivalent or better functional performance. We will not materially reduce the advertised processor class, graphics class, memory capacity, storage capacity, or other expressly guaranteed specification without the customer’s consent.
Prices, Taxes, and Errors
Prices are displayed in U.S. dollars unless stated otherwise. Applicable sales tax and shipping charges are calculated at checkout. We may correct typographical, pricing, inventory, or specification errors before shipment. If an error materially affects an accepted order, we may ask you to approve the correction or cancel and refund the affected unshipped item.
Promotions cannot be combined unless expressly stated. Price changes after an order is placed do not create a right to a price adjustment unless a written promotion expressly provides otherwise.
Order Acceptance and Verification
An order confirmation acknowledges receipt of the order and is not final acceptance. We may accept, reject, limit, or cancel an order before shipment for inventory, pricing error, payment failure, suspected fraud, unsupported address, purchase limits, legal compliance, or other legitimate reason. If we cancel an unshipped paid order, we will refund the amount collected for the canceled item.
We may request identity, payment, address, or authorization verification. Failure to respond may result in cancellation. We do not guarantee product availability until shipment.
Payment and Financing
Payment is due through the methods shown at checkout. Third-party payment, wallet, or financing services are governed by their separate agreements. We are not the lender and do not control financing approval, interest, fees, or posting times. Refunds to financed purchases remain subject to the Return Policy and the financing provider’s processing procedures.
Shipping, Returns, and Warranty
Our Shipping Policy, Return, Refund, Exchange & Cancellation Policy, One-Year Limited Hardware Warranty and RMA Policy, Monitor and Accessories Policy, and Privacy Policy are incorporated into these Terms. If a product page clearly states a product-specific term, that specific term controls only to the extent of a direct conflict for that product.
Software and Licenses
Software is licensed, not sold, and is subject to the applicable publisher’s license. Activation, account, subscription, and network requirements are the customer’s responsibility unless expressly stated. Opened, delivered, activated, or redeemed software and digital codes are non-returnable except where required by law.
Reviews and Submitted Content
If you submit a review, photograph, feedback, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and does not infringe another person’s rights. You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and adapt that content for operating, improving, and promoting the Services, subject to our Privacy Policy. We may moderate content but do not undertake to publish every submission.
Intellectual Property
The site, branding, designs, text, graphics, software, and other content are owned by or licensed to MLOONG DIGITAL LIMITED and are protected by applicable intellectual-property laws. No right is granted except the limited right to use the Services for personal, lawful shopping and support purposes.
Third-Party Services
Links, integrations, financing, payment, carrier, software, game, and manufacturer services may be provided by third parties. We are not responsible for a third party’s independent service, availability, content, or terms, except to the extent responsibility cannot be excluded under applicable law.
Service Availability
We may maintain, modify, suspend, or discontinue site features. We do not guarantee uninterrupted or error-free access. This does not affect an accepted order, valid return, or warranty obligation except as permitted by applicable law.
Disclaimer
Except for the express written warranty and rights that cannot be excluded, the site and Services are provided on an “as available” basis. To the maximum extent permitted by law, we disclaim other express or implied warranties concerning the site, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Product warranty rights are governed by the applicable written warranty and mandatory law.
Limitation of Liability
To the maximum extent permitted by law, MLOONG DIGITAL LIMITED and its service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, opportunities, or data; business interruption; or the cost of substitute equipment arising from the Services or a product. To the maximum extent permitted by law, aggregate liability for a claim will not exceed the amount paid for the product or service giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited, including any liability for fraud, willful misconduct, or other matter excluded by applicable law. Some states do not allow certain exclusions or limitations, so parts of this section may not apply to you.
Applicable Law and Consumer Rights
These Terms are governed by applicable law. Nothing in these Terms deprives a consumer of mandatory protections available under the law of the consumer’s state of residence or requires a dispute to be heard in a forum prohibited by applicable law. Before filing a claim, please contact info@mloongbld.com and give us a reasonable opportunity to resolve the issue informally.
Changes
We may update these Terms prospectively by posting a revised version with a new date. Terms applicable to a completed purchase are those presented when the order was placed, except where a change is required by law or is more favorable to the customer.
Severability and No Waiver
If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver.
